This notice describes how ELOVL handles consumer health data. It supplements our Privacy Policy and is provided to meet consumer health privacy laws, including the Washington My Health My Data Act and the Nevada consumer health data law. We apply it to all of our customers, not only residents of those states.
What we treat as consumer health data
Information that identifies your past, present, or future physical or mental health status. For us, that is primarily information you choose to tell us, such as details about your vision, eye conditions, diagnoses, or medications shared in a message, review, or survey, and any information you provide in connection with a diagnostic test we may offer.
How we collect it
We collect consumer health data directly from you, when you place an order or subscribe, when you contact customer support, and when you submit a review or respond to a survey. We do not buy consumer health data, and we do not collect it from outside sources to build a profile about you.
How we use it
We use it to fulfill and support what you asked for, to respond to your questions, to process returns and guarantee requests, and to meet our legal obligations. Where you have given consent, we also use it to improve our products and to send you information we think is relevant.
Consent
We collect consumer health data beyond what is necessary to provide the product or service you requested only with your consent, and we obtain separate consent before sharing it. You may withdraw consent at any time by emailing support@elovl.com, and withdrawal applies going forward.
We do not sell it
We do not sell consumer health data. Selling it would require your separate, signed authorization, and we do not seek one.
Who we share it with
Only service providers who need it to deliver what you asked for, such as payment processing, order fulfillment, and customer support, under contracts that limit them to that purpose. We also disclose it where the law requires. We do not use the health information you share with us to target advertising to you.
Your rights
You may ask us to confirm whether we collect, share, or sell your consumer health data, to identify the categories of third parties we have shared it with, to give you a copy, to delete it, and to withdraw your consent. Email support@elovl.com with the subject line Health Data Request.
We will respond within 45 days and will tell you if we need a further 45 days. If we deny your request, we will explain why, and you may appeal by replying to our response. We will give you a written decision on any appeal within 45 days, and if we deny the appeal we will tell you how to contact your state attorney general.
Deletion
When you ask us to delete consumer health data, we will delete it from our records and direct our service providers to do the same. We may retain information we are required to keep by law, such as transaction records for tax purposes, and we will limit its use to that purpose.
